Introduction

Ryan Greening of Bennington Green was appointed by a major UK airport operator as a quantum expert in a contentious matter whereby the Contractor had served a large claim on a complex large value project in regarding a number of change events and it included considerable sums for disruption and prolongation.

Our Approach

There were two significant matters contained within the Contractor’s claim, (1) to assess the quantum of the prolongation entitlement; and (2) to assess the quantum of a series of change events claimed to be associated with disruption and/or acceleration.

In regard to the prolongation entitlement Ryan prepared an analysis of the costs claimed for each member of staff against the record information available and used the audited costs to calculate a weekly ‘time slice’ of costs. A similar approach was adopted in the assessment of preliminaries materials and plant. The resulting analysis identified considerably disparity between the Contractor’s claim and the actual quantum assessed as due under the respective Contract.

The assessment of the disruption and acceleration required a different approach and required a detailed causal analysis before the quantum could be ascertained. Upon the facts becoming apparent Ryan was able to determine any entitlement arising out of the claimed event and identify the costs therefore accruing. Ryan undertook this analysis in conjunction with the airport’s programming expert as its event was, by its nature, fact sensitive.
